Learned counsel for the petitioner submits that the petitioner is challenging the impugned Action (Annexure P/3) whereby Respondent 4 who declared the petitioner as in-eligible candidate under PWD category (Both Arm) keeping in Teeth of their Own Examination Instruction & also bypassing the statutory provisions of the Right of persons with disabilities Act 2016 r/w the right of Digitally signed by JYOTI JHA Date: 2025.07.08 10:51:50 +0530
2 person with Disabilities Rule 2017 & made the petitioner in-eligible keeping in teeth of the statutory provision of section 58(3) of the Act 2016 without following due process of law. The petitioner has also placed representation dated 09.06.2025 (Annexure P-4) for redressal of his grievances, but no action has been taken with regard to the same till date.

Learned counsel for respondents submits that in view of the limited prayer made by the learned counsel for petitioner seeking direction to respondent-authorities to consider the pending application (Annexure P/9), they are having no objection to the limited prayer and if the claim of the petitioner is pending, it will be considered in accordance with law.
3. I have heard learned counsel for the parties and perused the material available on record.

Considering the facts and circumstances of the case instead of keeping this petition pending, I find it appropriate to dispose of the same at this stage directing the respondent-authorities to consider/decide the pending representation (Annexure P-4) dated 09.06.2025 of the petitioner as expeditiously as possible on its own merits in accordance with rules and regulations.
5. It is made clear that this Court has not observed anything on the merits of the case.
6. With the aforesaid direction, the writ petition is disposed of. Sd/-
