Zubeir Mr. Sudhir Yadav For Respondent(s) : Mr. Amit Kumar Gupta, PP Mr. Anirudh Tyagi Mr. Surendra Singh Ranawat, RPS, ACP Jhotwara HON'BLE MR. JUSTICE ANIL KUMAR UPMAN Order 27/01/2025 1. The instant bail application has been filed under Section 483 of BNSS on behalf of the petitioner, who has been arrested in connection with FIR No.558/2024 registered at Police Station Jhotwara, District Jaipur (West) for the offences punishable under Sections 109(1), 115(2), 126(2) & 3(5) of BNS. 2. Learned counsel for the petitioner submit that petitioner has falsely been implicated in this case. It is submitted that simple case of road accident has been converted into criminal offence. Learned counsel contend that vehicle in question was being driven by co-accused Ganesh Tholiya and petitioner was sitting on alongside the driver seat. It is contended that after investigation, [2025:RJ-JP:3750] (2 of 2) [CRLMB-13198/2024] police has submitted charge-sheet. Learned counsel argues that petitioner is in custody since 08.09.2024. Trial will take considerable time in its conclusion and further custody of the petitioner would not serve any fruitful purpose. 3. Learned Public Prosecutor assisted by learned counsel for the complainant vehemently oppose the submissions made by counsel for the petitioner. 4. Investigating Officer, who is present in person, submits that he has received the file for verification of the investigation under the directions of higher authorities. He submits that as per doctor’s opinion, victim/injured is not in position to give his statement and, therefore, he has not given his final report. 5. I have considered the contentions. 6. Considering the gravity of offence and nature of allegations levelled against the petitioner as also the fact that statement of victim has not been recorded by investigation agency, this Court is not inclined to enlarge the petitioner on bail. 7. Accordingly, the instant bail application is dismissed. (ANIL KUMAR UPMAN),J CHARU SONI /98
