ORDER:
The present Writ Petition is filed under Article 226 of the Constitution of India seeking the following relief:
“…to issue a WRIT OF MANDAMUS declaring the action of the respondents herein particularly Respondent Nos.3 and 4 in threatening to dispossess the petitioner from the peaceful possession and enjoyment of the house property of an extent of Ac. 0.03 cents in Plot No.34, situated at Sy.No.589-A1 of Usthikayalapenta Village, Yerravaripalem Mandal, Tirupati District, Erstwhile Chittoor District, without issuing any notice or opportunity of personal hearing or following the due process of law is questioned as the same is arbitrary, illegal, contrary to the well-established legal principles apart from being violative of fundamental and constitutional rights guaranteed under Articles 14, 21 and 300-A of the Constitution of India and consequently direct the Respondents, not to interfere with the petitioners peaceful possession and enjoyment of the subject house property in Sy.No.589-A1 of Usthikayalapenta Village, Yerravaripalem Mandal, Tirupati District, Erstwhile Chittoor District and pass such other order or orders as this Court may deem fit and proper in the circumstances of the case”.
2. The learned Assistant Government Pleader has placed the written instructions, dated 15.09.2025 addressed by the Tahsildar, Yarravaripalem Mandal, Tirupati District. As seen from the written instructions (part of the record), it is emphasized that the revenue officials, including the field functionaries (VRO and Revenue Inspector), have not at any time interfered with the possession and enjoyment of the petitioner. The allegation of dispossession or interference made by the petitioner is false, vexatious and without any basis in the revenue records. No notice has ever been issued nor any
4 proceedings initiated by the authorities against the petitioner with respect of the subject property.
3. Recording the averments made in the written instructions that the respondents never interfered with the possession of the petitioner over the subject property, the Writ Petition is closed. There shall be no
order as to costs.
