Following order was passed in this matter on 14.10.2025:-
“Learned Additional Advocate General has placed on record copy of consideration order dated 10.10.2025 passed by the Engineer-in-Chief, HPPWD, Shimla.
Taking note of the judgment passed in the case of the petitioner on 04.04.2025 and the consideration
order dated 10.10.2025, which prima facie, appears to be absolutely contrary to the settled legal position as also the facts, let respondent No.2-Engineer-in-Chief, HPPWD, Shimla to remain present in the Court tomorrow

Pursuant to above, learned Additional Advocate General has placed on record fresh consideration order dated 14.10.2025 passed by the Engineer-in-Chief, HPPWD, Shimla. In terms of the said order, case of the petitioner has been allowed for family pension and the Executive Engineer HPPWD Division Dalhousie, has been directed to take necessary steps for extending the benefits to the petitioner at the earliest.

Learned Additional Advocate General submits that in order to process the pension case of the petitioner and release of admissible pension/family pension to her, some time is required for completing the codal formalities and that respondents shall earnestly make an endeavour to complete all the codal formalities for release of admissible pension/family pension in favour of the petitioner within four weeks.

Learned counsel for the petitioner also submits that petitioner would also render full cooperation to the respondents for the aforesaid propose.

In view of above submissions and also taking into note of the office order dated 14.10.2025, present execution petition to stand disposed of with hope and trust that the benefits flowing to the petitioner under the aforesaid office
order shall be released in her favour within four weeks. However, liberty is reserved to the petitioner to seek appropriate remedy for the redressal of her surviving grievances, if any, in accordance with law.
Pending miscellaneous application(s), if any, also to stand disposed of.
