04/ 18.12.2025 Heard learned counsel for the petitioner and learned A.P.P for the State.

The petitioner is apprehending his arrest in connection with Pratappur P.S. Case No. 11 of 2024, registered for the offence under Sections 406, 420 and 409 of the Indian Penal Code, pending in the court of learned Sub-Divisional Judicial Magistrate, Chatra.

Learned counsel appearing for the petitioner submits that the petitioner happened to be the Secretary of the Bharhi PAX. He next submits that the allegations are made that 6791.83 quintal of paddy was collected having the moisture and in view of that the loss occurred to the Government is Rs. 19,64,925/-. He further submits that the petitioner has already deposited the amount to the tune of Rs. 15,70,000/- and only Rs. 2,70,000/- is further required to be deposited by the petitioner and to buttress his argument he refers to Annexure-2, which is the document to suggest that certain amount has been returned. He also submits that the petitioner is willing and ready to deposit the rest of the amount. He then submits that the said fact has also come in para-157 of the case diary.

Learned A.P.P. appearing for the State has opposed the

prayer and submits that certain amount has not yet been paid, however, on query by the court, learned A.P.P. appearing for the State submits that in para-157 of the case diary, it has come that Rs. 13 lakhs and odd has been deposited by the petitioner.

Considering that the petitioner has deposited the substantial amount suo motu and he is intent to deposit the further amount, I am inclined to grant anticipatory bail to the petitioner.

Accordingly, the petitioner, named above, is directed to surrender before the learned court within three weeks from today and in the event of his surrender / arrest, the petitioner, named above, shall be released on bail, on furnishing bail bonds of Rs. 25,000/- (twenty- five thousand), with two sureties of the like amount each, to the satisfaction of learned Sub-Divisional Judicial Magistrate, Chatra, in connection with Pratappur P.S. Case No. 11 of 2024, subject to conditions as laid down under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.
