On the basis of report lodged by complainant Satish Panwar about incident of 11.09.2022 for assault by Rajveer, Lal Chand and others on his father Jagdish Panwar, the matter is investigated. During investigation post-mortem of Jagdish was conducted and after investigation a charge-sheet has been filed against Rajveer, Kalu Ram, Lal Chand and Suman. [2025:RJ-JP:35312] (3 of 3) [CRLMB-13119/2024] Three accused persons Kalu Ram, Lal Chand and Suman were granted bail by a Co-ordinate Bench of this Court on 31.07.2023
7. A status report is called from the trial court while considering first bail application of petitioner accused then it was revealed that 20 witnesses were listed by prosecution. At the time of filing of current bail application 15 witnesses were already examined and during pendency of this bail application may be all other witnesses were examined.
It means that the trial is at fag end and likely to conclude very soon. 8. The evidence on record as referred by learned counsel is considered by us. The allegation upon present petitioner is for causing a deadly assault on head of Jagdish with a sharp edged weapon (axe). If there are two sets of evidence one pointing finger towards present petitioner and other towards other then it is a subject matter to be considered at the time of final adjudication but this is not a ground to release present petitioner on bail, who is main accused in the instant case. 9. Hence, the this bail application preferred by petitioner accused-Rajveer S/o Puranmal, is hereby dismissed. 10. The trial court is directed to expedite the trial and try to conclude as early as possible. (ASHOK KUMAR JAIN),J CHETNA BEHRANI /3
