The present contempt application has been filed pleading willful disobedience of the order dated 5.2.2025 passed by this Court in Writ-C No. 35418 of 2024. Through order dated 5.2.2025, this Court had stayed the effect and operation of the order dated 9.10.2024 passed by the Regional Food Controller, Basti Region, Basti, i.e., opposite party insofar as it blacklisted the petitioner. Through the order dated 9.10.2024, the opposite party had cancelled the contract previously awarded to the petitioner vide order dated 22.6.2024 and in addition to the aforesaid had also blacklisted the applicant. The contempt application has been filed with the plea that despite the order dated 5.2.2025, the opposite party has not restored the contract awarded to the applicant vide order dated 22.6.2024 and has, therefore, willfully disobeyed the order passed by this Court for which the opposite party is liable to prosecuted and punished for Contempt of Court. The contention is not acceptable. Through order dated 9.10.2024, this Court had cancelled the contract awarded to the applicant and had also blacklisted the applicant. The order dated 5.2.2025 only stayed the operation of the order dated 9.10.2024 so far as it blacklisted the applicant but did not stay the order dated 9.10.2024 so far as it cancelled the contract awarded to the applicant. In view of the aforesaid, it is not a case to institute proceedings under the Contempt of Court Act, 1971. The contempt application is dismissed.
