The petitioner is before this Court seeking the following prayer: “To issue a writ of mandamus directing respondent No.5/returning officer to carry out the counting process to the 6th respondent election in one place and videograph the same as per the representation given by the petitioner dated 20/01/2025 vide Annexure- C.” - 3 - NC: 2025:KHC-D:1785 WP No. 100434 of 2025 2. This Court on 23.01.2025 had passed the following order: “Learned AGA on instructions would submit that the votes would be counted under one roof and under different as is alleged as the allegation is counting of votes is happening in each booth. If that be so, it is blatantly contrary to law. In the light of the submission of the learned AGA that counting would be done under one roof, list this matter on 12.02.2025.” 3. The learned AGA on instructions submitted that there was no apprehension of the kind that the votes would be counted in different booths where votes were polled and they would be counted under the same roof. 4. In the light of the said undertaking, the votes shall be counted under one roof and strictly in consonance with law. 5. With the aforesaid observation, the petition stands disposed.
