THIS PETITION, COMING ON FOR ADMISSION, THIS DAY, ORDER WAS MADE THEREIN AS UNDER: CORAM: HON'BLE MR JUSTICE S.R.KRISHNA KUMAR ORAL ORDER In this petition, petitioners seek the following relief:- “Quash the entire proceedings in C.C.No.14819/2023 (Crime No.79/2023) registered by the 1st respondent (Bagalgunte Police Station) pending on the file of XXXI Addl. Chief Metropolitan Magistrate, Bengaluru against the petitioners for the offences punishable under Sec. 498(A) r/w 34 IPC and Sections 3 and 4 of Dowry Prohibition Act, 1961 in the interest of justice.” - 3 - HC-KAR NC: 2025:KHC:22078 CRL.P No. 9390 of 2024 2. Learned counsel for the petitioners – accused Nos.1 and 2 and learned counsel for 2nd respondent – complainant have filed an Application along with Joint Affidavit duly signed by the petitioners, 2nd respondent and their respective counsel and the same is taken on record. 3. Petitioners – accused Nos.1 and 2 and their counsel and 2nd respondent and her counsel are physically present before the Court and they admit the contents of the Joint Affidavit, which reads as under:- “JOINT AFFIDAVIT We, Pradeep Rao Jadhav, S/o Devarao Jadhav, Aged about 37 years, and Lalitha Bai G.S., W/o Devarao Jadhav, Aged about 51 years, Both R/at No.34, Samruddi Nilaya, 6th Cross, Vishveshwaraiah Layout, Sidehalli Main Road, Bagalgunte, Bengaluru – 560 073 (petitioners) and Pooja S Bhousle., W/o Pradeep Rao Jadhav., Aged 35 years, R/at No..109, 1st Cross Road, Marithinagar, Mahadeshwaranagar, Herohalli Cross, Sunkadakatta, Bengaluru – 560 091 (respondent No.2) do hereby solemnly affirm & state on oath as follows- 1. We are the petitioners and respondent No.2 in the above case. We know the facts of the case. Hence, we are swearing to this affidavit. - 4 - HC-KAR NC: 2025:KHC:22078 CRL.P No. 9390 of 2024 2. We state that the above Criminal Petition is filed seeking to quash the entire proceedings in C.C.No.14819/2023 (Crime No.79/2023) registered by the 1st respondent (Bagalpunte Police station) pending on the file of the XXXI Addl. Chief Metropolitan Magistrate, Bengaluru against the petitioners for the offence punishable under Sec. 498(A) r/w 34 IPC and Sec. 3 and 4 of Dowry Prohibition Act 1961. 3. We state that the family dispute between us has been settled in M.C.No.3704/2023 before the VI Addl. Principal Judge, Family Court, Bengaluru through mediation. We state that as per and the clause 9(d) and 11 of the memorandum of settlement entered by the parties rendered before the mediation center and have admitted to close the criminal cases filed each other and to withdraw all the allegations made each other either in the petition or orally. We are producing the copy of the decree dated 06/06/2025 passed in MC No.3704/2023 and the memorandum of settlement arrived between us before the mediation center Bengaluru dated 27/03/2025. The said documents are produced herewith and marked as Document Nos.1 & 2. 4. We state that since all family disputes have settled amicably the petitioners and the 2nd respondent have no objection to allow this petition and consequently quash the proceedings pending before the trial Court. This averment made in the affidavit are free from compulsion, coercion or any other sort of undue influence and tendered with free will and the same are true to the best of our - 5 - HC-KAR NC: 2025:KHC:22078 CRL.P No. 9390 of 2024 knowledge, belief & information, which we believe them to be true.” 4. In view of the aforesaid settlement entered into between the petitioners and 2nd respondent, I pass the following: ORDER (i) The petition is disposed of in terms of Joint Affidavit dated 19.06.2025. (ii) The proceedings in C.C.No.14819/2023 (arising out of Crime No.79/2023 of 1st respondent – Police) registered for the offences punishable under Sections 498A r/w 34 of IPC and Sections 3 and 4 of the Dowry Prohibition Act, 1961, pending on the file of XXXI Addl.
