1. The petitioner has filed this petition seeking the following relief(s):-
“10.1 It is prayed that this Hon'ble Court may kindly be pleased to call for the entire records pertaining to the case of the petitioner, in pursuance of the communication by Divisional Joint Director, Treasury Account and Pension dated 26.05.2015. 10.2 Issue a writ of mandamus to direct the Respondents to release the held up pension, gratuity, encashment of earned leaves and other post retirement benefits for which the Petitioner is eligible for, with immediate effect. 10.3 Any other relief/reliefs, which this Hon'ble Court may think fit and proper in the facts and circumstances of the case, with cost of the petition, may also please be granted to the Petitioner.” REKHA SINGH Digitally signed by REKHA SINGH

Mr. Bajpayee, learned Panel Lawyer appearing for the State would submit that an affidavit has been filed by the competent authority, wherein, it is stated that except the amount of gratuity, rest part of the retiral dues has already been paid to the petitioner. He would further submit that the amount of gratuity would be paid to the petitioner at the earliest and process in this regard has been initiated. It is also informed by Mr. Bajpayee that there is no dispute with regard to entitlement of the petitioner to the amount of gratuity.

4. Taking into consideration the submissions made by Mr. Bajpayee and the contents of affidavit filed by the Associate Professor, Department of Anatomy, CIMS, Bilaspur (C.G.) this petition is disposed of with a direction to the competent authority to make payment of gratuity within a period of 60 days from today.
