The petitioner is apprehending his arrest in connection with Koderma P.S. Case No. 61 of 2025, registered under sections 303(2)/62/3(5) of BNS, pending in the Court of learned Chief Judicial Magistrate, Koderma. 3. Learned counsel for the petitioner submits that petitioner is not named in F.I.R however on receipt of notice under section 35(3) of BNSS, 2023, he came to know about the present case. He further submits that allegation is made of committing theft of battery of generator and the name of the petitioner has been taken by the co-accused. On these grounds, he submits that the petitioner may kindly be provided privilege of anticipatory bail. 4. Learned counsel for the State opposes the prayer and submits that the name of the petitioner has been taken by the co-accused. 5. Considering that petitioner is not named in F.I.R and the name of the petitioner has come in the confessional statement of co-accused, I am inclined to grant anticipatory bail to the petitioner. Accordingly, the above named, petitioner is directed to surrender before the learned court within ( 2025:JHHC:37925 ) three weeks from today and in the event of his surrender / arrest, the petitioner shall be released on bail, on furnishing bail bonds of Rs. 25,000/- (twenty five thousand) with two sureties of the like amount each, to the satisfaction of learned Chief Judicial Magistrate, Koderma, in connection with Koderma P.S.
