[2025:RJ-JP:16250] HIGH COURT OF JUDICATURE FOR RAJASTHAN BENCH AT JAIPUR S.B. Review Petition (Writ) No. 182/2024 In S.B. Civil Writ Petition No.9305/2023 Rajasthan Public Service Commissioner, Through Its Secretary, Ajmer (Raj). ----Petitioner Versus
1. Sulochana Daughter Of Shri Jhabar Mal Gurjar, Aged About 28 Years, Resident Of Village And Post Chala, District Sikar (Raj).
2. State Of Rajasthan, Secondary Education Department, Through Its Principle Secretary, Govt. Secretariat, Jaipur (Raj).
3. Director, Education Department, Secondary Education, Rajasthan Bikaner (Raj). ----Respondents For Petitioner(s) : Mr. M.F. Baig For Respondent(s) :
HON'BLE MR. JUSTICE SUDESH BANSAL
Order 16/04/2025
1. As per Office report, there is a delay of 403 days in filing of present review petition, for which a separate application u/s. 5 of the Limitation Act has been filed by review petitioner.
2. Taking into consideration the facts that before filing of this review petition against the final order dated 11.08.2023 passed in S.B. Civil Writ Petition No.9305/2023, petitioner preferred DB Special Appeal (Writ) No.1007/2023, which was dismissed vide order dated 08.07.2024 with liberty to appellant (review petitioner herein) to approach the Writ Court, delay in filing review petition is hereby condoned.
3. Heard learned counsel for review petitioner- Rajasthan Public Service Commission (RPSC) on the review petition.
4. It appears that the original writ petitioner, in the writ petition, raised a grievance for not changing her category from OBC to MBC, in
[2025:RJ-JP:16250] (2 of 2) [WRW-182/2024]
order to consider her candidature in MBC category for the post of School Lecturer, Subject- Hindi, pursuant to the advertisement dated
28.04.2022.
5. It further appears that since the RPSC permitted to change category of writ petitioner and her candidature was allowed to be considered in the MBC category, in view of such subsequent fact, writ petitioner moved an application (IA No.1/2023), seeking withdrawal of writ petition, which was allowed by this Court and the writ petition was
disposed of as having become infructuous, vide order dated
11.08.2023.
6. Though, the contention of counsel for review petitioner- RPSC is that the permission to change the category of writ petitioner from OBC to MBC in the online application form, was granted by RPSC in pursuance of the interim order, passed in the writ petition, however, no document in support thereof, has been enclosed with the review petition. Otherwise also, counsel for review petitioner is not able to satisfy this Court that change of category of writ petitioner from OBC to MBC, is not permissible in law.
7. This Court is of the considered opinion that neither there is any error apparent on the face of record nor order dated 11.08.2023 set any precedence of law and there is no good reason to review the final
order dated 11.08.2023. Accordingly, the review petition, being devoid of substance, is hereby dismissed.
8. Pending application(s), if any, stand(s) disposed of.
