Neutral Citation No. - 2025:AHC:56489 Court No. - 6 Case :- CRIMINAL MISC. BAIL APPLICATION No. - 10432 of 2025 Applicant :- Nitesh Alias Ankit Opposite Party :- State of U.P. Counsel for Applicant :- Ashish Kumar Pandey Counsel for Opposite Party :- G.A. Hon'ble Saurabh Shyam Shamshery,J. 1. Heard Sri A.K. Pandey, learned counsel for applicant and learned AGA for State. 2. There are specific allegations against applicant of causing firearm injury to one of deceased which is also referred in statement of eye-witness. 3. Argument of learned counsel for applicant that it is a case of parity that bail was granted to other assailant, however, he has failed to show any reason assigned in said bail order, therefore, Court is not bound to follow such orders when on basis of material, there is very specific evidence against present applicant. 4. Other argument of learned counsel for applicant that applicant is in jail for about 3 years would also not be a sufficient ground since it could not be considered as a prolong detention period considering nature of allegations against applicant. 5. Considering aforesaid submissions, at this stage, I do not find any ground to release applicant on bail, hence, bail application is rejected. 6. However, a liberty is granted to applicant to approach this Court or trial Court for bail, as the case may be, if trial is not substantially progressed within 8 months from today.
