N SRIHARI The Court made the following: 2 ORDER: The present Writ Petition is filed under Article 226 of the Constitution of India for the following relief: "…..to issue a Writ, Order or Direction more particularly one in the nature of Writ of Mandamus, declaring that the action of the 3rd Respondent in not passing the orders pursuant to enquiry report submitted by 4th Respondent Dt.10.07.2024 and also not disposing the complaints Dt.12.09.2024, 30.09.2024 & 04.10.2024 by the 2nd Respondent/Dist. Collector, is as illegal, arbitrary and violative of Principles of Natural Justice and Article 14 of the Constitution of India, apart from fundamental rights guaranteed under the Constitution and consequently direct the 3rd Respondent to pass orders pursuant to enquiry report submitted by the 4th Respondent Dt.10.07.2024, also directing the 2nd Respondent to dispose of the complaints Dt.30.09.2024 & 04.10.2024 within a time frame and pass such other order or orders….." 2. The present Writ Petition is filed aggrieved by the action of the 3rd respondent in not taking decision on the enquiry report submitted by 4th respondent. 3. Learned Government Pleader appearing for the respondents has filed written instructions dated 12.02.2025 across the bench. 4. As seen from the said written instructions, it transpires that the Divisional Panchayat Officer has already commenced the enquiry on 06.02.2025 and it will take six weeks time to submit final report in the matter, as the constituted committee has to verify the records in detail pertaining to the last five years and two weeks needed to process the report together it needs six weeks time. 3 5. Without delving into the merits of the case, this Court is inclined to dispose of the Writ Petition, directing the concerned authority, where the enquiry is pending, to conclude the enquiry within a period of eight (8) weeks from today. 6. With the above direction, the Writ Petition is disposed of. There shall be no order as to costs.
