“10.1 This Hon'ble Court may kindly be pleased to direct the respondent authority to come with all the records in the present case. 10.2 This Hon'ble Court may kindly be pleased to set aside the impugned transfer order dated 25.06.2025 (Annexure P/1), or the authority may be directed to transfer the service of the petitioner at his Home District- Durg (C.G.) in the interest of Justice. 10.3 That, the respondent authority may kindly be
directed to consider the grievance of the petitioner as per the transfer policy, and till the decision taken by the authority, status quo may kindly be grant in favour of the petitioner, in the interest of justice. 10.4 This Hon'ble Court may kindly be pleased to issue any other order or orders, writ or writs, direction or directions as this Hon'ble court may deem fit in the facts and circumstances of the case in favor of the Petitioner, in the interest of justice.”

Learned counsel for the petitioner would submit that, by the impugned transfer order dated 25.06.2025, the petitioner, who is working as Treasury Officer at District Treasury Office, Balod, District Balod, has been transferred to the office of Assistant Director, Directorate Pension and Provident Fund, Atal Nagar, Nawa, Raipur as the Assistant Director. The petitioner is going to be retired on 30th June, 2026 and as per the transfer policy, the employees, who are having less than one year of their tenure cannot be transferred. Against the transfer order, the petitioner has moved his representation before the Transfer Committee on 27.06.2025,
3 but till date, his representation has not been considered. He would further submit that, the Collector Balod (respondent No.3) has also recommended for cancellation of the transfer order of the petitioner vide recommendation dated 04.07.2025. Since the representation of the petitioner is pending before the Transfer Committee, the Transfer Committee may be directed to consider and decide the representation of the petitioner as early as possible within the stipulated time frame. 3. The submissions made by learned counsel for the petitioner is not opposed by the State counsel and he would submit that, they have no objection, if such a direction for consideration of the representation of the petitioner within the stipulated time frame is made. 4. Considering the submissions made by learned counsel for the parties and considering the issue involved in the case, and also considering that the petitioner has already moved his representation on 27.06.2025 under clause 8 of the Transfer Policy dated 05.06.2025, which is pending before the Transfer Committee and also in view of the recommendation made by the Collector Balod (respondent No. 3), dated 04.07.2025, the Transfer Committee is directed to consider and decide the pending representation of the petitioner dated 27.06.2025 within a period of 30 days from the date of receipt of a copy of this order, in accordance with law, on its own merits, keeping in view the conditions of the Transfer Policy as well as recommendation dated 04.07.2025 made by the Collector, Balod. The petitioner is also at liberty to move an application for any interim direction for staying his transfer order till the decision of the committee. 4
5. The petitioner is also directed to produce a copy of this order to the Transfer Committee within a week from today. 6.
