1. Heard on I.A. No. 01/2025, which is an application for grant of ad- interim bail to the applicant. 2. At the outset, learned counsel for the applicant seeks permission to withdraw I.A. No. 01/2025. Accordingly, I.A. No. 01/2025 is dismissed as withdrawn. 3. 2 Bilaspur (C.G.), for the offence punishable under Sections 7,8,9,10,12 of the Prevention of Corruption Act, 1988 and 61(2), BNS 2023. 4. The first bail application of the applicant was disposed off by this Court being MCRC No. 3766 of 2025, vide order dated 13.05.2025 by granting a temporary bail / short term bail on the ground that his son was suffering from blood cancer. 5. As per the case of the prosecution, on 25.04.2025, the applicant was caught receiving a bribe of Rs. 31,93,500/- from co-accused Mr. Manoj Pathak (employee of M/s Jhajharia Nirman Ltd.) on behalf of his brother Mr. Vishal Anand, Chief Engineer, RSW, SECR, Bilaspur at Birsa Chowk, Ranchi, Jharkhand. 6. Learned counsel for the applicant submits that he does not want to press this second bail application on merits and he only prays for a temporary bail / short term bail on the ground that his son is suffering from blood cancer and for which, he has to be taken for treatment. 7. On the other hand, learned counsel for the non-applicant opposes the bail application of the applicant, but could not dispute the fact that the applicant’s son is suffering from blood cancer. 8.
I have heard learned counsel for the parties and perused the case diary. 9. Taking into consideration the fact that the applicant does not want to press this second bail application on merits and he only prays for release on bail on the ground that his son is suffering from blood cancer, the second bail application filed on behalf of applicant-Kunal Anand is rejected. However, considering the fact that son of the applicant is suffering from blood cancer and his treatment is required and this fact has been verified by the non-applicant, I am inclined to
3 grant parole/short term bail to the applicant for the period of two months from the date of his release on an undertaking that he shall surrender before the concerned trial Court on the date to be given by the trial Court on his furnishing a personal bond with two sureties in the like sum to the satisfaction of the concerned trial Court. The applicant is directed to cooperate with the investigation, if so required and during the release on parole/ short term bail, he shall not indulge in tempering of evidence or involve in any criminal activities, failing which, temporary bail granted to him shall automatically stands cancelled. The trial Court is at liberty to take him into custody and sent him to jail. 10. Office is directed to send a certified copy of this order to the trial Court concerned for necessary information. Sd/-
