a _ ----- Dr. YLR, J CrI.P.No.9322 of 2025 Dated 16.09.2025 The Court made the following: ORDER: The Criminal Petition has been filed under Section 482 o'f the Bharatiya Nagarik Suraksha Sanhita, 2023 (for brevity lthe BNSS') by the petitioner/Accused No.1 for granting of pre-arrest bail in connection with Crime No.174 of 2025 of Punganur Urban Police Station, Chittoor District, registered for the alleged offences punishable under Sections 332 (b), 79, 351 (2) read with 3 (5) of the Bharatiya Nyaya Sanhi{a, 2023 (for brevity lthe BNS])
2. The case of the prosecution is that on 02.07.2025 at about 4.30 P.M., at the complainantJs house in Mudipapanapalle, Punganur Mandal, the complainant, P. Jyothi, was present along with her mother-in-law when A1-Mahendar Reddy, al.ong with A2-Ameerulla and two others, trespassed into the house armed with sticks, abused them in filthy language, and threatened them to withdraw the cases filed against Al before the Hon]ble Court, failing which they would face`dire consequences. On hearing her cries, the complainant's sons rushed to the spot, whereupon the accused fled. The offence arose out of a land dispute between the parties and is a counter case to Cr.No.173/2025 of punganur police stati`6-h':~Hence, the F!F3.

3. Sri D.Purna Chandra Reddy, the learned counsel forthe petitioner, contends that the petitioner is the innocent of the alleged offence and has been falsely implicated by the police. It is further submitted that the petitioner is the sole earning member of the family and, therefore, his incarceration would cause undue hardship to his dependents. The petitioner undertakes to strictly ad;lere to any conditions that may be imposed by this Court. ln light of the foregoing submissions, learned counsel prays that the present petition be a[l6wed in the interest of justice-

Per cot,fra, Ms.P.Akhila Naidu, the learned Assistant Public Prosecutor vehemently opposed the grant of pre-arrest bail to the petitioner, submitting that the investigation is still undervay and several material witnesses remain to be examined, lt is contended that if the petitioner is released on pre-arrest bail, there is a strong likelihood that he may abscond, thereby hampering the ongoing investigation and evading the process of law, and urged to dismiss the petition. /,

As seen from the record, the allegation against the petitioner/Accused No.1 is that he, along with others, trespassed into the house of the de-facto complainan{, abused them, and threatened with dire consequences that.if they did not withdraw the case filed against the petitioner and other accused, they would see their end. The learned I counsel for the petitioner submits that the wife of Accused No.1 had lodged a complaint in Cr.No.173 of 2025`, wherein three persons suffered severe injuries at the hands of the relatives of the de-facto complainant. 7. Considering the facts and circumstances of the case, the gravity and nature of the allegations levelec' against the petitioner, the alleged role played by him in this case, this Court deems i{ fit to grant pre-arrest ba]'l to the petitioner. 8.
In the result, the Criminal Petition is allowed with the following conditions: i. In the event of his arrest, the petitioner/Accused No.1 shall be enlarged on bail subject to he executing a personal bond for a sum of Rs.10,000/- (Ru-pees Ten Thousand only) with two sureties for the like sum each to i-..-, I .4 the satisfaction of the arresting police officials-. r -=*-ch-~= i.? 5 Dr. YLR, J Crl.P.No.9322 of 2025 Dated 16.09.2025 ii. The petitioner/Accused No.1 shall make himself available for investigation as and when required; iii. The petitioner/Accused No.1 shall notcause any threat, inducement or promise to the prosecution witnesses ; iv. The petitioner/Accused No.1 shall appear beforethe Station House Officer concerned once in a week i.e., on every Saturday between 10.00 a.m. and 5.00 p.m., till filing of the charge sheet. v. The petitioner/Accused No.1 shall not leave the limits of the District without the express permission from the Station House Officer concerned. vi. The petitioner/Accused No.1 shall surrender his Passport, I'f any, tO the investigating Officer. ]f he Claims that he does not have a passport, he shall submit an affidavit to that effect to the Investigating Officer.
