DATTA PURKAYASTHA Order 14/03/2026 On reference to under Section 19 of the Legal Services Authorities Act, 1987, the case is taken up today in the National Lok Adalat held in the Court premises of the High Court of Tripura. The case is settled between the parties amicably as per the terms of settlement signed by them and the Conciliators/Members. The case is disposed of, in terms of settlement which reads as follows: <The mediation has been made between the parties in presence of the conciliators and both the parties have agreed to settle the matter with the following terms and conditions: The petitioner shall appear before the office of the Deputy Director of ARDD, Nalkata, within 10(ten) days from today (14.03.2026) and shall supply all the necessary papers and information for forwarding the pension proposal etc. Accordingly, the ARDD shall prepare the pension proposal etc. within a period of one month from today (14.03.2026) and shall forward the same to the higher authority with a copy to the petitioner. It is also stated by the ARDD that the excess amount was paid to the petitioner for extra work for about 10(ten) months and they asked for adjustment of the same. But the Lok Adalat have decided that if she has worked for that period and the department have received her service as an employee (permanent labour), the amount shall not be recoverable or adjustable so their claim is not allowed. The person present from the Finance Department have stated that the matter was not informed to them either by the petitioner or by the ARDD, so they are not aware of the matter and they could not say anything in this matter. The Finance Department shall take every endeavor, if required, for settling the pension proposal of the petitioner if the ARDD requires the same and forward the same. With this, the matter is settled and the case is finally decided with this order.= Terms of settlement have been placed in the case record and the same shall be treated as part of this order.
