02/18.12.2025 Heard learned counsel appearing for the petitioner and learned counsel appearing for the State.
2. The petitioner is apprehending his arrest in connection with Balumath P.S. Case No.101 of 2025, registered for the offence under Sections 303(2), 317(5) of the BNS, Section 21 of Mines Mineral (Development & Regulation) Act, Rule 13 of the Jharkhand Minerals (Prevention of Illegal Mining, Transportation and Storage), Rules, 2017 and Section 30(ii) of the Coal Mines Act, pending in the Court of the learned Chief Judicial Magistrate, Latehar.

Learned counsel appearing for the petitioner submits that the petitioner is the driver of the Hywa. He further submits that the allegations are made that 30 tons of coal was illegally being loaded on the said Hywa. He next submits that the petitioner was not present on the spot. He also submits that the petitioner has got no criminal antecedent, as disclosed in paragraph 14 of this application. He then submits that the owner of the Hywa has been granted anticipatory bail in A.B.A. No.6300 of 2025.

Learned counsel appearing for the State opposed the prayer and submits that the allegations are there that the coal was illegally being loaded on the said Hywa.

Considering that the petitioner is the driver of the Hywa and he has got no criminal antecedent and the owner of the Hywa has been granted anticipatory bail in the aforesaid A.B.A. and in the attending facts and circumstances of the case, I am inclined to extend the privilege of anticipatory bail to the petitioner.

Accordingly, the above-named petitioner is directed to surrender before the learned Court within three weeks from today and in the event of his arrest or surrender, he shall be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Latehar in connection with Balumath P.S. Case No.101 of 2025, subject to the conditions as laid down under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.
