The petitioner has filed the present writ petition challenging his transfer order dated 26.06.2025, where by the petitioner who is working as Assistant Grade- II has been transferred from the Officer of Executive Engineer, Public Health and Engineering, Division- Janjgir Champa to Officer of Executive Engineer, Public Health & Engineering, Division- SAGRIKA AGRAWAL Digitally signed by SAGRIKA AGRAWAL Date: 2025.07.19 14:37:49 +0530 2 Sarangarh, showing his transfer on his own request. 2. Learned counsel for the petitioner would submit that the petitioner has never made any application for his transfer, yet he has been transferred showing that the same is being made on his own request. It is only to accommodate other person in place of petitioner, the petitioner has been transferred. There is no to administrative exigency to transfer the petitioner at Sarangarh Division. Therefore, his transfer order may be quashed. 3. Learned counsel for the State, on instruction, would submit that there is no application filed by the petitioner with respect to his transfer and it appears that by mistake, it has been mentioned that the petitioner is to be transferred on its own request. 4. Considering the submissions made by learned counsel for the Parties and considering the issue involved in the present case, the impugned transfer order dated 26.06.2025 with respect to the petitioner’s transfer from Janjgir Champa Division to Sarangarh Division is quashed. The petition shall be permitted to work there at his original place of posting i.e. Office of Executive Engineer, Public Health & Engineering, Division- Janjgir Champa. The State is at liberty to place the petitioner at an appropriate place on administrative exigency, if so arises. 5. With the aforesaid observation, the present petition is allowed.
