At the very outset, Sri Arvind Prabodh Dubey, learned counsel for the opposite party raised objection and submitted that present transfer application has been filed under Section 24 CPC to transfer the proceeding of Maintenance Case No.948 of 2021, under Section 125 Cr.P.C., arising out of criminal dispute, whereas, it has to be filed under Section 407 Cr.P.C, therefore, transfer application is not maintainable. 3. Sri Yaqoob Ali Ansari, Advocate holding brief of Sri Akash Kumar Verma, learned counsel for the applicant could not dispute the aforesaid facts. 4. Accordingly, transfer application is dismissed with liberty to applicant to file fresh application under the provision of Section 407 Cr.P.C., if so advised.
