Mr. Rahul Consul, Advocate for the petitioner appeared through video conferencing. Mr. Mahendra Singh Bisht, Brief Holder for respondent nos.1 and 2. Learned Chief Standing Counsel takes notice on behalf of the respondent nos.1 and 2. It is the case of the petitioner that the respondent no.3, Sri Shambhu Paswan has contested election of the Nagar Nigam, Rishikesh claiming himself as a Scheduled Caste person, but in some transactions, he has shown himself as General Category Candidate. Petitioner seeks inquiry into this matter. Heard learned counsel for the parties and perused the record. During the course of hearing, learned counsel for the petitioner would submit that he had already moved an application to the District Magistrate, Dehradun so that an inquiry may be conducted with regard to Scheduled Caste status of the respondent no.3. But, it is argued that it has yet not been decided. Learned State counsel would submit that the representation may be decided within a period of four weeks after hearing all the stakeholders. The Court takes on record the statement given by the learned State counsel. The District Magistrate Dehradun shall take a decision on the representation made by the petitioner, after affording an opportunity of hearing to the parties within a period of four weeks.
