JUSTICE DEEPAK ROSHAN ----------- For the Petitioner : Mr. Abhishek Kumar, Advocate For the Respondents : Dr. (Mrs.) Vandana Singh, Advocate ---------- 02/ 08.05.2025 In the instant writ application the following prayer has been made: (a) For issuance of an appropriate writ(s)/ order(s)/ direction(s) particularly in the nature of Certiorari for quashing and setting aside the grounds of non -consideration of petitioner's claim of payment of ex-gratia amount, as disclosed and contained in the proposal dated. 28/05/2021 (Annexure-6), being the same on non-est grounds (b) For issuance of an appropriate writ (s)/Order(s)/direction(s) particularly a writ in the nature of mandamus commanding upon the respondents' to consider and grant the payment of ex-gratia amount of Rs 15 lakhs to the petitioner as her husband died of Covid-19 and the deceased was a contractor's worker the only qualification for payment to the eligible dependent of contractors' worker dying of Covid-19 under office order dated 14/08/2020 (Annexure-4) 2025:JHHC:13872 2 2. At the outset, learned counsel for the petitioner submits that the representation of the petitioner is already pending before the concerned respondent, however, the same has not yet been considered. As such, the concerned respondent be directed to take decision on his representation. 3. Learned counsel for the respondents submits that since no counter- affidavit has been filed, as such, the petitioner may be directed to file fresh representation before the respondents, who shall decide the case in accordance with law. 4. Having regard to the aforesaid facts and circumstances, the instant writ application is hereby disposed of by directing the petitioner to file fresh representation before the concerned respondent-authority. The moment the concerned respondent will receive any such representation, he shall take decision in accordance with law and applicable rules and regulations, within a period of 12 weeks from the date of receipt of such representation. 5.
