HON'BLE MR. JUSTICE MAHENDAR KUMAR GOYAL
Order 19/02/2025 This writ petition is directed against the seizure notice dated 20.08.2024 passed by the Nagar Nigam, Ajmer whereby, the subject property was seized for a period of 90 days and the order dated 27.09.2024 passed by the Director, Local Bodies, Rajasthan, Jaipur whereby, an appeal preferred by the petitioners thereagainst, has been dismissed. A perusal of the notice impugned dated 20.08.2024 and
order impugned dated 27.09.2024 reveals that the seizure was for a period of 90 days which has expired long back. In view thereof, this Court is of the view that this writ petition is rendered infructuous by efflux of time.
[2025:RJ-JP:7232] (2 of 2) [CW-18597/2024] However, learned counsel for the petitioners submits that despite lapse of the period of 90 days, the respondents have not removed their seal over the subject property. In view thereof, the respondents are directed to remove the seal forthwith from the sealed property or to apprise the petitioners the reason(s) for non-removal of the seal despite lapse of the period of seizure within a period of three days from the date the petitioners approach them. With the aforesaid observations, this writ petition is disposed of. Pending application(s), if any, also stands disposed of accordingly.
