THIS PETITION, COMING ON FOR ADMISSION, THIS DAY, ORDER WAS MADE THEREIN AS UNDER: CORAM: HON'BLE MR JUSTICE ASHOK S.KINAGI ORAL ORDER Learned counsel for the petitioner submits that the award passed by the Arbitrator was challenged by the petitioner under Section 34 of the Arbitration and Conciliation Act, 1996 (‘the Act, 1996’ for brevity). The said application was allowed by the learned District Judge. The respondent aggrieved by the order passed under Section 34 of the Act, 1996, preferred an appeal under Section 37 of the Act, 1996. The said appeal is pending before this Court. In view of the pendency of the appeal, this petition does not survive for consideration and prays to dismiss the petition. 2. Submission is placed on record. 3. Accordingly, the Civil Miscellaneous petition is dismissed. - 3 - NC: 2025:KHC:13348 CMP No. 396 of 2024 4. However, liberty is reserved to the petitioner in case if any order is passed in the appeal filed by the respondent under Section 37 of the Act, 1996, the petitioner can seek for revive this order.
