The present application u/s 528 of B.N.S.S. has been filed with prayer to quash the entire proceedings of Case No. 11566 of 2023 (State vs. Const. Rahul Yadav and Another), arising out of Case Crime No. 10 of 2023, under Sections 323, 504, 506, 427, 34, 147, 148 of I.P.C., P.S. Gagalhedi, District Saharanpur, as well as cognizance/summoning order dated 28.8.2023, pending in the Court of C.J.M., Saharanpur. After some arguments, learned counsel for the applicants does not want to press the present application. In view of above, the present application u/s 528 of B.N.S.S. is dismissed as not pressed with liberty to file appropriate application/proceedings before the court of competent jurisdiction.
