The present application has been filed to quash the summoning order dated 06.12.2022 as well as the entire proceedings of Complaint Case No.4032 of 2022, under Section 406 I.P.C., pending in the Court of Judicial Magistrate, Ghaziabad. 3. Learned counsel for the applicant submits that the parties have settled their dispute amicably and, therefore, he does not want to press this application and the same may be dismissed as withdrawn. 4. It is further submitted by counsel for the applicant that initially this matter was referred to the mediation centre by order dated 13.07.2023. 5. In compliance of order dated 13.07.2023, the applicant has already deposited Rs.25,000/- before the mediation centre, but opposite party no.2 did not appear before the mediation centre and that amount is still lying with the mediation centre. He submits that the said amount may be directed to be released in favour of the applicant. 6. In view of the above, the present application is dismissed as withdrawn. 7. The mediation centre is directed to return Rs.25,000/- to the applicant deposited by him in pursuance of order dated 13.07.2023, and if already not released in favour of opposite party no.2.
