JUSTICE RAJESH SHANKAR ----- For the Petitioner: Mr. Vishnu Prabhakar Pathak For the State: Mr. Sahbaj Akhtar, A.C to A.A.G-III ----- 06/24.03.2025 The present writ petition has been filed for issuance of direction upon the respondent No.4 to dispose of Encroachment Case No. 01/2022-23 with respect to the land appertaining to Khata No. 18, Plot No. 08, Village-Choura, Thana No. 450, District-Palamau, measuring an area of about 0.22 Acre, the nature of which, according to the petitioner, is ‘Gair Mazurwa Malik’. Further prayer has been made for issuance of direction upon the respondent No.4 to dispose of Encroachment Case No. 07/2021-22 with respect to the land appertaining to Khata Nos. 18 & 19, Plot Nos. 44 & 47, Village-Choura, Thana No. 450, District- Palamau, measuring an area of about 0.04 Acre & 0.08 Acre respectively, the nature of which, according to the petitioner, is ‘Gair Mazurwa Malik’. The petitioner has also prayed for issuance of direction upon the respondent No.4 to dispose of Land Encroachment Case No. 08/2021-22 with respect to the land appertaining to Khata No. 67, Plot No. 233, Village-Arka, Thana No. 448, District-Palamau, measuring an area of about 0.06 Acre, the nature of which, according to him, is ‘Gair Mazurwa Malik’. 2. Learned counsel for the petitioner submits that the petitioner, who is the resident of Village-Choura, P.S-Tarhasi, District-Palamau, filed various applications before the respondent No.4 with respect to encroachment of public land i.e. road, drainage, temple premises by the private respondents. The grievance of the petitioner is that though the respondent No.4 has registered the aforesaid encroachment cases, however, the same have not yet been disposed of. 3. Mr. Sahbaj Akhtar, learned A.C to A.A.G-III appearing on behalf of the respondent-State, submits that if the aforesaid encroachment cases are still pending, the respondent No.4 shall take all possible steps to dispose of the same in accordance with law without further delay. 4. Having heard learned counsel for the parties and considering the nature of the prayer made in the present writ petition, if the aforesaid encroachment cases are still pending, the respondent No.4 shall make endeavours to dispose of the same in accordance with law after providing due opportunity of hearing to all the concerned parties within a reasonable period. 5.
