ORDER:
1. The present Writ Petition is filed questioning the action of the Respondents in blocking the road from Kutagulla Village, Kadiri Mandal, Satya Sai District, running on the left side of the Kutagulla Railway line, by placing a 4 feet height barricade, thereby denying the right of the Petitioners to use the road for transportation of goods and carriages, as illegal and arbitrary. The facts leading to filing of the present Writ Petition Z.. are as follows:- The Petitioners, who are the residents of Kutagulla Village, rely on the said road to access the main Kadiri-Ananthapur Highway. The Petitioners contended that earlier the Respondents placed a 9 feet barricade on the road and subsequently it was reduced to 4 feet and consequently the villagers are not able to utilize the road. 3. The learned counsel for the Petitioners submits that there reason for the Respondent authorities to place a barricade as there is hardly vehicle movement on the road and further submits that by placing a barricade, the residents of the village are compelled to take was no
-rt long road to access the Kadiri-Ananthapur Highway for sending the agricultural produce. 4. This Court on 29.04.2025 passed interim orders directing the Respondent authorities to remove the barricades on the road pending further orders. 5. The learned Standing Counsel for Respondent No.5-Municipality passed on two letters signed by the Commissioner, Kadiri Municipality stating that no barricades have been removed pursuant to the order dated 29.04.2025 passed by this Court and it is further stated that no barricades or obstructions will hereafter be placed on the said road or any public thoroughfare within his jurisdiction without due process of law and due justification. The relevant portion of the letter is extracted as hereunder:-
“The said removal was carried out on 23.06.2025 under my supervision, thereby restoring unhindered access and ensuring free movement for the villagers, including the transportation of goods. This action was taken in strieT adherence to the Hon’ble Court’s directions and in recognition of the lack of any valid proximate habitation warranting such a barricade. reason or I further undertake and assure this Hon’ble Court that barricades or obstructions will hereafter be placed on the said road or any public thoroughfare within my jurisdiction without due process of law and due Justification. ” no

In the light of the instructions given by the Respondent No.5- Municipality, no further orders are required to be passed in this Writ Petition. 7. Accordingly, the Writ Petition is closed.
