Heard Sri C.Subodh, learned counsel for the Petitioner and Ms.K.Priyanka Lakshmi, learned Assistant Public Prosecutor on behalf of the State. 3. Learned counsel for the petitioner would submit that the post of Judicial First Class Magistrate, Kota is currently vacant. The incharge officer is conducting the proceedings only once a week. The Court is not entertaining the application of the petitioner seeking permission to go abroad for pursuing his higher studies. Learned counsel for the petitioner would further submit that let there be a direction to the Court to number the petition and dispose of it according to law. 4. Learned Assistant Public Prosecutor would submit that the Court may pass appropriate Orders. 3 5. Considering the submissions made, it is apposite to dispose of the present petition directing the concerned Court to entertain the petition which is to be filed by the petitioner/Accused No.3 seeking the permission to go abroad for pursuing higher studies and dispose of it on merits according to law within a period of two (2) weeks from the date of receipt of copy of this Order. 6. With this observation, the Criminal Petition is disposed of.
