Currently Village Bubani, Police Station Gegal District Ajmer (Raj.) (At Present Petitioner Confined In District Jail, Ajmer). ----Petitioner Versus State Of Rajasthan, Through PP ----Respondent For Petitioner(s) : Mr. Govind Upadhyay For Respondent(s) : Mr. Manvendra Singh, PP HON'BLE MR. JUSTICE PRAVEER BHATNAGAR
Order 27/02/2025
1. The instant bail application has been filed under Section 483 BNSS on behalf of accused-petitioner. The petitioner has been arrested in connection with FIR No.110/2024 registered at Police Station Gegal, District Ajmer for the offence(s) under Sections 302 and 201 of IPC.
2.
Learned counsel for the accused-petitioner submits that the accused-petitioner has falsely been implicated in this case. He further submits that there is no reliable evidence available on record to indicate role of the accused-petitioner in the alleged incident. The brother of the deceased Pradhan, in his cross- examination has clearly stated that Prabhu Singh's Aadhar Card was recovered from the deceased body, therefore, the recovery shown at the instance of accused-petitioner Sonu Singh is entirely
[2025:RJ-JP:8647] (2 of 2) [CRLMB-12872/2024] incorrect. The accused-petitioner is in custody since long and further trial of the case may take considerable time, therefore, the bail application of the accused-petitioner may be allowed.
3. Learned Public Prosecutor has vehemently opposed the bail application and contended that after investigation, it was found that the accused-petitioner was seen together with the deceased in the CCTV footage, thereafter at the instance of the accused- petitioner Aadhar Card of the deceased person was recovered, therefore, the bail application of the accused-petitioner may be dismissed.
4. Heard and perused the material available on record.
5. It is not desirable to express anything on the merits of the case. It is alleged against the accused-petitioner that he was last seen with the deceased in the CCTV footage and his presence was found in the CCTV footage. Apart from that, at the instance of the accused-petitioner, Aadhar Card of the deceased was recovered, therefore, considering the above facts, this Court is not inclined to enlarge the accused-petitioner on bail.
6. Hence, the bail application of the accused-petitioner is hereby dismissed.
