2. The applicant has filed this second bail application under Section 482 of BNSS for grant of anticipatory bail, apprehending his arrest in connection with Crime No. 190/2015 registered at Police Station Gol Bazaar, Raipur, District Raipur, CG for the offence
2 punishable under Sections 409, 420, 294, 506 and 34 IPC.

Learned counsel for the applicant submits that though the first application for grant of anticipatory bail was dismissed by this Court in MCRCA No. 1381 of 2015 vide order dated 10.02.2016, that will not come in the way of entertaining this second application. He submits that the applicant is innocent, that charge-sheet has already been filed and that co- accused have already been acquitted of the charges leveled against them and being so, this bail application may be allowed.

Learned counsel for the respondent opposes this application and submits that as the first application has already been dismissed by this Court on merits and as he is absconding for last nine years, that he may be waiting for the result of the trial Court resulting in acquittal of the other accused persons, therefore, the application cannot be entertained and is liable to be dismissed.

Be that as it may, after hearing learned counsel for the parties and considering the fact that the first anticipatory bail application was dismissed on merits way back in the year 2016 and that after lapse of nine long years, this Court is not inclined to grant anticipatory bail to the applicant.
6. Accordingly, this anticipatory bail application is dismissed. Sd/-
