The present application under Section 528 of BNSS has been filed to quash the order dated 18.1.2025 passed by Additional Sessions Judge, FTC, Court No.2, Hathras in Misc.Case No.90 of 2023 (State vs. Ujagar Singh and another) whereby an application to discharge the applicants as a surety in S.T. No.130 of 2015 (State vs. Mahesh) under Section 307 IPC has been dismissed. After some arguments, learned counsel for the applicants does not want to press the application and wants liberty to file a appropriate application before the court of competent jurisdiction. Certified copy of the relevant documents may be returned to the learned counsel for the applicants after retaining a xerox thereof. In view of the above, the application is dismissed as not pressed with the aforesaid liberty.
