This Second Appeal was filed by the appellant/defendant under Section 100 of the Code of Civil Procedure, 1908 (for short, 'C.P.C.') against the Judgment and decree, dated 17.07.2002 passed in A.S.No.42 of 1999 on the file of learned 1st Additional District Judge’s Court, Cuddapah, reversing the judgment and decree, dated 16.04.1999 passed in O.S.No.25 of 1995 on the file of learned III Additional Junior Civil Judge’s Court, Cuddapah. 2. Learned counsel for the respondent is present. 3. A perusal of the docket proceedings dated 02.01.2025 shows that the learned counsel appearing for the appellant is no more and this Court ordered notice to the appellant. Registry sent notice to the appellant to the same address as shown in the appeal, but it was returned with an endorsement ‘address is insufficient’. 4. In view of the above circumstances, except for dismissal of the appeal this Court has no other option to proceed further with the appeal. 5. Accordingly, the Second Appeal is dismissed for default.
