[2025:RJ-JP:6438] HIGH COURT OF JUDICATURE FOR RAJASTHAN BENCH AT JAIPUR S.B. Criminal Bail Cancellation Application No. 198/2022 Manoj Chandvani S/o Chimman Lal, Aged About 45 Years, R/o House No. 74, Arya Samaj Mandir Munim Pada, Gangapur City, District Sawai Madhopur (Raj.) ----Petitioner Versus State Of Rajasthan, Through P.p. ----Respondent For Petitioner(s) : None present For Respondent(s) : Mr. Vivek Sharma, AGA Mr. Harendra Sharma HON'BLE MR. JUSTICE FARJAND ALI (THROUGH VIDEO CONFERENCING) Order 13/02/2025 1. None present on behalf of petitioner. On earlier occasion when the matter was listed on 20.12.2024, 12.06.2024, 31.05.2024, 16.02.2024 & 12.01.2024 no one appeared on behalf of the petitioner to pursue the cause raised in the petition for cancellation of the bail. I have heard counsel appearing for accused respondent and learned PP. Gone through order dated 18.05.2022 whereby the bail was granted by this Court to the accused respondent. 2. The bail granted by this Court was made to challenge by way of filing a special leave petition before Hon’ble the Supreme Court and vide order dated 14.10.2022 the same has been dismissed while giving a liberty to the petitioner that in case any instance of [2025:RJ-JP:6438] (2 of 2) [CRLBC-198/2022] misusing of concession of bail by the respondent is observed, then he would file an application for cancellation of bail. 3. The bail was granted by this Court on 18.05.2022. Now more than two and half years have passed and not a single instance has been shown to this Court where the accused respondent has made any endeavor to threat, coerce, pressurize or intimidate the petitioner. The bail granted by exercising discretionary jurisdiction cannot be canceled on mere assertion of bald and vague allegation. There must be some substance and it should be well founded. There is no force in the instant application, accordingly it is dismissed. 4. This Court is well guided by the principles of law expounded by Hon’ble the Supreme Court in case of Bhagirath Sinh s/o Mahipat Singh Judeja vs. State of Gujrat 1984 AIR 372 and the same also applies here in this case.
