This writ petition is filed delcaring the action of the 3rd Respondent in issuing the Notice No.05/2024/TPO dated 30.09.2024 under Section 461(1) of the HMC Act, 1955 applicable to GVMC to the 4th Respodnent as illegal and arbitrary and consequently direct Respondent Nos.2 and 3 to remove/pull down the unauthorized construction made by the 4th Respondent in the Petitioner’s plot admeasuring 146.6 Sq. Yards covered by Sy.No.105/7 situated at Dagguvanipalem of Pendurthi Mandal, Visakhapatnam District.
2. Subsequent to the institution of the writ petition, the building plan vide B.A.No.1086/4439/B/Z8/EGE/2024 dated 25.11.2024 was issued to Respondent No.4, pursuant to the report from the Town surveyor.
3. In that view of the matter, the cause in the writ petition does not survive for adjudication any longer.
4. The writ petition is therefore dismissed as infructuous, leaving it open to the Petiioner to challenge the building plan issued in favour of Respondent No.4. No order as to costs.
