1. Heard learned Counsel for the petitioner and learned Additional Public Prosecutor for the State. 2. This application, for grant of anticipatory bail, arises out of Bangra Police Station Case No. 53 of 2023, disclosing offences under Sections 191(2), 190, 115(2), 126(2), 118(1), 121(1), 121(2), 125, 125(A), 125(B), 49, 109(1), 303(2), 324(4), 317(2), 61(2) of the BNS, 2023. 3. As per the prosecution case, after a laborer named Suryakant Kumar died in an accident at Duratek Cement Factory, police officers visited the scene. There, around 150 people had caused damage to the factory. A group of antisocial individuals attacked the police, pelted stones, tried to snatch a rifle, stole money, and assaulted the informant by means of

Learned Counsel for the petitioner submits that petitioner has not committed any offence in the manner alleged. There is no specific allegation levelled against the petitioner. Petitioner has been made accused merely on the basis of disclosure of his name by local chowkidar. No eye-witness has supported the prosecution case. 5. I have heard the parties and have gone through the materials available on record including the impugned order. The petitioner is having criminal antecedent and he has been identified creating ruckus through a video footage. There is allegation against him of abusing, assaulting and pelting bricks and stones on the police officials and he is also named in the F.I.R. He along with the other co-accused persons created unruly scene when the police party arrived to discharge their official duty. An attack on police team while on official duty undermines the safety and security of law enforcement agency.
Incidents of mob violence against law enforcement agency have become the order of the day now in this State which can be very dangerous, often escalating tensions and compromising public safety, accordingly, I am not inclined to grant the petitioner
