SUTHAR Date : 07/07/2025 ORAL ORDER [1.0] The petitioner has preferred this petition, seeking to invoke extraordinary jurisdiction of this Court under Article 226 and supervisory jurisdiction under Article 227 of the Constitution of India so also inherent powers of this Court under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short “BNSS”) [section 482 of the Code of Criminal Procedure, 1973] with a prayer to release Muddamal Samsung Mobile as prayed for in the petition which has been seized in connection with an FIR being C.R. No. 11191008230526 of 2023 registered with Chandkheda Police Station, District Ahmedabad City for the offence punishable under the Indian Penal Code and Atrocity Act. [2.0] In view of the fact that mobile is sent to the FSL, learned Advocate for the applicant on instructions seeks permission to withdraw the present petition with liberty to file appropriate proceedings after receiving the muddamal from the FSL. Permission is granted. With the above liberty the present petition is deposed of as withdrawn. This Court has not gone into the merits. (HASMUKH D.
