GP FOR FINANCE PLANNING The Court made the following: 2 ORDER : This Writ Petition is filed under Article 226 of the Constitution of India seeking the following relief: “....to issue an appropriate Writ, Order or direction more particularly one in the nature of Writ of Mandamus declaring the action of the Respondents in withholding the payments of pending amounts of Rs.36,46,846/- (Thirty Six Lakhs Forty Six Thousand Eight Hundred And Forty Six Rupees only) even after finalizing the bills payable to the petitioner in relation to the works i.e.,I. Genaral Fund 2022-23 Laying of BT Roads and Construction of CC Drain and RCC Culvert at Ravindra nagar 0 line from Railway gate to Anurag old age home in Div no 35 under AE2 Section in Guntur Municipal Corporation Agreementno 222/202324 Dated 05 01 2024…” 2. Heard learned counsel for the petitioner and learned counsel appearing for the respondents. 3. Learned counsel for the petitioner submits that even though respondents admitted that the petitioner is entitled for payment of the aforesaid sum of money, no payment is being made and such non-payment of money is clearly arbitrary and high-handed and thereby requires interference by this Court. 4. The 2nd respondent filed a detailed counter, wherein it is stated that the 2nd respondent Corporation entered into Agreement No. 222/SE/GMC/GNT/2023-24, dated 05.01.2024, and the said work was completed within three months, i.e., on 04.04.2024. The petitioner commenced the work on 08.01.2024 and completed it on 28.02.2024. A check 3 measurement was conducted by the Deputy Executive Engineer on 29.02.2024, after which the file was circulated for payment. The Executive Authority approved the bill on 01.07.2024. The bill has already been uploaded to the CFMS portal under ID No. 2024-2175445, and the payment is to be automatically credited to the petitioner’s account. 5. In view of the fact that the bills claimed by the petitioner are admitted bills, this Court feels it appropriate to dispose of the writ petition directing the respondents to clear the same within a period of four (4) months from the date of receipt of a copy of this order. 6. Accordingly, the Writ Petition is disposed of. There shall be no order as to costs.
