Respondent authorities in cancelling the local pass status to the non-commercial vehicles on the ground of registration of the vehicle outside the limits of the toll plaza B. Respondents 4 and 5 in cancelling the local pass status for the petitioners car bearing No. TS 13 EN 3335 with fast tag account No.21448271 as arbitrary, illegal, null and void and against the norms of public policy and principles of natural justice and contrary to Clause 9(3) of the National Highways Fee (Determination of Rates and Collection) Rules, 2008 and to issue consequential directions i) directing the 4th respondent to restore the monthly local pass status for the petitioners car bearing No. TS 13 EN 3335 with fast tag account No.21448271, ii) directing the 2nd respondent authority to take action against the respondents 4 and 5, who have been illegally collecting toll fee contrary to Clause 9(3) of the National Highways Fee (Determination of Rates and Collection) Rules, 2008 and iii) directing the respondents 4 and 5 to remit the amounts collected illegally from the petitioners fast tag account No.21448271 with ICICI Bank from 1st September, 2025, and to pass IA NO: 1 OF 2025 Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased to direct the 4th respondent to issue local pass status to the petitioner’s vehicle bearing No. TS 13 EN 3335 with fast tag account No.21448271 forthwith pending disposal of the above Writ petition and to pass Counsel for the Petitioner: 1. On the other hand, Sri A. Venkata Durga Rao, learned Standing Counsel appearing for respondents 2 to 4 placed on record the instructions. The operative portion of the written instructions reads as under: (i) From the FasTag account of the Petition an amount of Rs.1300/- was deducted during his travel through Kaza fee plaza from 02.09.2025 to 05.09.2025 at the rate of Rs.175/- for a single trip and Rs.85/- for return trip for a total of 4 days (Rs.260 x 5 full trips). TCA has informed that local monthly pass has been activated w.e.f. 05.09.2025 to the Petitioner’s vehicle no.TS13 EN 3335 (Copies attached) TCA has also initiated the process of refund of Rs.1300/- to Petitioner, Shri G. Venkat Sailendra on 06.09.2025 (Copies attached). (ii) Further, PIU has issued a 7 days show cause notice to TCA, M/s Sri Sai Enterprises for denying the Monthly Local Pass to Mr. G. Venkat Sailendra w.e.f. 01.09.2025 (Copy attached). 3. Recording the instructions submitted by the learned Standing Counsel, no further orders are required in this writ petition. 4. Accordingly, the Writ Petition is closed. No order as to costs.
