JUSTICE ALOK KUMAR PANDEY ORAL ORDER 2 23-04-2025 Heard learned counsel for the petitioner and learned A.P.P. for the State. 2. The petitioner seeks bail in connection with Sahebpur Kamal P.S. Case No. 110/2024, G.R. No. 1550/2024 registered for the offences punishable under Sections 147, 341, 323, 307, 325, 379, 504 of the Indian Penal Code. 3. As per prosecution case, petitioner and others are said to have assaulted the informant. It is alleged that co- accused Deepak Yadav and Sandip Yadav are said to have assaulted the informant by means of iron rod as a result of which he sustained head injury. 4. Patna High Court CR. MISC. No.22010 of 2025(2) dt.23-04-2025 2/3 case. The petitioner is languishing in custody since 04.01.2025 and bears criminal antecedent of four cases in which he is on bail. Allegation against the petitioner is general and omnibus in nature. He further submits that injury report of the informant is simple in nature caused by hard blunt substance as mentioned in Annexure-2 of the bail petition. Learned counsel for the petitioner orally submits that charge sheet has been submitted in this case and there is no likelihood of tampering with the prosecution evidence. On similar and identical allegation, co- accused Sikandar Yadav and Bhikho Yadav @ Indrajit Yadav have already been granted bail by the co-ordinate Bench of this Court vide Cr. Misc. No.59309/2024 and Cr. Misc. No.8111/2025 respectively and on the principle of parity, the petitioner also deserves same treatment. 5. The learned A.P.P. for the State vehemently opposed the prayer for bail of the petitioner. 6.
Considering the facts and circumstances of the case, period of custody, co-accused persons have already been granted bail, argument advanced on behalf of both sides and also taking into consideration the material available on record, let the petitioner above named be released on bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two

No. 1550/2024, subject to following conditions:- (i) One of the bailors shall be either father or mother or sister or brother or wife or the person who has sworn the affidavit in bail application. (ii) Petitioner will co-operate in trial and will remain present on all dates and absence for two consecutive dates without appropriate permission, would be a ground for cancellation of bail by the learned Trial court itself.
