PATIL ORAL ORDER (PER: HON'BLE MRS JUSTICE VIJAYKUMAR A. PATIL) This Contempt Petition is filed alleging willful disobedience of the Order dated 20.04.2023 passed by the learned single Judge in W.P.No.2534/2022 (LB-RES). 2. Operative portion of the Order reads as under: (i) The writ petition is allowed. - 4 - HC-KAR NC: 2025:KHC:18968-DB CCC No. 925 of 2023 (ii) The respondent No.3 is directed to consider the representations submitted by the petitioners at Annexure-A to A15 within a period of six weeks from the date of receipt of copy of this order in accordance with law, if necessary by calling upon the petitioners to supply any further documents. (iii) The petitioners are also permitted to file such documents as the petitioners seek to rely upon to the concerned respondent. (iv) This Court has not expressed any opinion on the merits of the matter. 3. In the present contempt petition, accused No.2/respondent has entered appearance and filed statement of objections on 03.11.2023 and 25.03.2025. Along with the statement of objections filed on 25.03.2025, endorsement dated 12.12.2024 was produced. The said endorsement indicates that the representation of the petitioners/ complainants has been considered in detail by assigning reasons and came to be rejected. 4. Sri R.Kalyan, learned counsel for the complainants submits that the contents found in the endorsement dated 12.12.2024 are far from truth and no inspection has been - 5 - HC-KAR NC: 2025:KHC:18968-DB CCC No. 925 of 2023 carried out and no constructions have come up as stated in the said endorsement. He also contends that the proceedings were not conducted in the presence of the complainants. The aforesaid submission cannot be gone into in this proceedings. The correctness of the endorsement cannot be adjudicated in the present contempt petition and the complainants have to challenge the same in accordance with law. 5. In view of the said rejection of the representation, present contempt petition is closed reserving liberty to complainants to seek available remedy against the endorsement dated 12.12.2024 in accordance with law.
