Sandhya Katiyar assaulted the brother of the first informant namely Sanjeev and sister in Law (Bhabhi) Ratna Katiyar and when the son of the first informant, namely Om Katiyar, tried to save them the applicant
has given blow by Sabad over the head of Om Katiyar, Sanjeev Kumar and his wife Ratna and due to which the son of the first informant become unconscious. He further submits that the co-accused Sandhya Katiyar has already been granted bail by the Court below vide
order dated 15.12.2024. He has no criminal antecedent and there is no likelihood of his fleeing from course of justice or tampering with evidence in case of release on bail. Hence, bail has been prayed for.
Learned counsel for the first informant as well as learned A.G.A. vehemently opposed the bail application by submitting that specific role has been assigned to the applicant of giving blow of Sabar over the head of the son of the First Informant namely Om Katiyar, Sanjeev Katiyar and Smt. Ratna Katiyar, and due to which all of them have sustained serious injuries and the Doctor in his statement has specifically said that due to injuries sustained by the Om Katiyar, his left side of body is not properly working. Having heard learned counsel for the parties and gone through materials placed on record, it is apparent that it is a case of sudden provocation and both sides have sustained injuries, co-accused Sandhya Katiyar, has already been granted bail, applicant has no criminal antecedents and considering the all above facts and circumstances, the nature of accusations, severity of the punishment in the case of conviction and nature of supporting evidence, reasonable apprehension of tampering with the witness and prima facie case, but without commenting on merit of case, a case for bail is made out. Accordingly, the bail application is allowed.
Let the accused-applicant, Maheep Katiyar, involved in above mentioned case crime number be released on bail, on his executing a personal bond and two reliable sureties each, in the like amount to the satisfaction of the court concerned, subject to the following conditions:
