[2025:RJ-JP:8623] HIGH COURT OF JUDICATURE FOR RAJASTHAN BENCH AT JAIPUR S.B. Criminal Miscellaneous 4th Bail Application No. 12969/2024 Raj Agarwal S/o Shri Ravi Kumar Agarwal, R/o 53-A, Mansa Nagar, Sirsi Road, Ps Bhankrota, Jaipur (Presently In Central Jail At Jajipur). ----Petitioner Versus State Of Rajasthan, Through PP ----Respondent For Petitioner(s) : Mr. Alok Sharma For Respondent(s) : Mr. Naresh Gupta, P.P.
HON'BLE MR. JUSTICE VINOD KUMAR BHARWANI
Order 27/02/2025
1. The 4th bail application has been filed under Section 439 Cr.P.C./483 B.N.S.S. on behalf of the accused-petitioner, namely Raj Agarwal S/o Shri Ravi Kumar Agarwal, in connection with FIR No.239/2021 registered at Police Station Bhankrota, Jaipur for the offence(s) under Section(s) 302 & 201 of I.P.C.
2.
Learned counsel for the accused-petitioner submits that the petitioner has been falsely implicated in this case, he has nothing to do with the alleged offences & he is behind the bars since
29.07.2021. The statements of the prosecution-witnesses have been recorded during trial & later-on some of the prosecution witnesses turned hostile. Counsel further submits that the Investigating Officer neither investigated the neighbours & mother of the petitioner, namely Rupa nor recorded their statements.
[2025:RJ-JP:8623] (2 of 2) [CRLMB-12969/2024] Looking to the overall facts and circumstances of the case, the petitioner may be entitled for regular bail in this matter.
3. Learned Public Prosecutor has vehemently opposed the bail application and submitted that the matter is fixed for final
arguments before the learned Trial Court. He further submits that the petitioner was caught with the dead body. Trial of the case is not likely to take a long time to conclude. Thus, the 4th bail application filed under Section 439 Cr.P.C./483 B.N.S.S. deserves to be dismissed.
4. Considered the overall allegations leveled in the FIR, the impugned order and the contentions made by learned counsel for the accused-petitioner.
5. Thus, without commenting upon the merits/demerits of the case and looking to the overall facts and circumstances of the case, this Court does not deem it appropriate to grant the benefit of regular bail to the accused-petitioner.
6. Accordingly, the 4th bail application filed under Section 439 Cr.P.C./483 B.N.S.S. is dismissed.
