Mr. Vinod Fulara, Advocate for the petitioner, through video conferencing. Mr. Devesh Ghildiyal, Standing Counsel for the State/respondents. The petitioner has brought to the notice of the Court that the order dated 29.12.2023 passed by this Court in WP (S/S) No. 2514 of 2017, Santram @ Nanhe & Ors. V. State of Uttarakhand & Ors. has been wilfully disobeyed. In fact, petition was decided on 29.12.2023 in terms of judgment dated 28.12.2023 rendered by this Court in WP (S/S) No. 1957 of 2017, and others connected matters, by which the order was passed for deciding the representation. Today, at the very outset, learned State Counsel gives a statement that the petitioner’s representation has been decided on 18.07.2024. Learned counsel for the petitioner submits that the copy of the order dated 18.07.2024 has not been served on the petitioner. He submits that the petitioner would like to withdraw the petition. Contempt petition may not be withdrawn. The petitioner only brings to the notice of the Court that the Court’s order has been wilfully disobeyed. In the instant matter, what is stated is that the order of the Court has already been complied with and the representation that was filed by the petitioner has been
decided. But, it was also incumbent on the respondents to serve a copy of the order by which the petitioner’s representation was rejected. Let this be so served within three days from now. Since, the order of the Court has already been complied with, this Court does not see any reason to make any interference. The contempt proceeding is closed.
