H.P. Agriculture University Pensioners Sabha Vs. CSKHPKV CMP No.23449/2025 13.10.2025 Present: Mr. Rishi, Advocate, vice counsel, for the petitioner. Mr. Prince Chauhan, Advocate, for the respondent- University. This application has been moved by the respondent- University seeking extension of time by eight weeks to implement the judgment rendered on 23.07.2025 in CWP No. 10878/2025 (H.P. Agriculture University Pensioner’s Sabha Vs. CSKHPKV & Anr.). 2. Heard learned counsel on both sides. 3. The aforesaid writ petition pertained to petitioners having not been released retiral benefits due & admissible to them. After considering the entire case on both sides, following directions were issued in the main writ petition: - “5. In view of above, impugned order dated 25.03.2025 (Annexure P-8) holding that release of remaining amount of leave encashment due to the members of petitioner’s Society shall be considered as and when additional funds are received, is quashed and set aside. Respondents are directed to release the admissible leave encashment due to the members of the petitioner’s Society within six weeks from today, failing which, the amount shall carry interest @5% per annum from the actual due date. Pending miscellaneous application(s), if any, shall also stand disposed of.” The stand taken by the respondent-University in this application for extension of time for releasing due & admissible retiral benefits has otherwise already been rejected in the above writ petition. 4. Keeping in view the ratio of the decision, no case is made out to allow this application. It is also worth mentioning that the application seeks eight weeks’ time to implement the judgment, whereas, six weeks have already gone by from the date on which the application was filed. In view of above, the application is dismissed. Jyotsna Rewal Dua Judge 13th October, 2025 (Rohit)
