28.07.2025 W.P.A. 15491 of 2025 Item No.107 Ct. No.35 dc. Mantu Das alias Mantu Kumar Das versus The State of West Bengal & Ors. Mr. Shataroop Purkayastha, Ms. Jagriti Bhattacharya ... For the Petitioner. Mr. Tanmay Kumar Ghosh, Mr. Monoj Mondal … For the State. Affidavit-of-service filed in Court today be kept with the record. Report submitted by the learned advocate appearing for the State be also kept with the record. A copy of the report be handed over to the learned advocate appearing for the petitioner. The petitioner is aggrieved by the fact that a criminal case being Sabang P.S. Case No. 403 of 2024 dated 10.11.2024 was registered for investigation against the present petitioner and thereafter on conclusion of investigation, charge- sheet was submitted, but the petitioner’s grievance is that he has been thrown out of the house and he is not allowed to enter the residence at the behest of the wife and her relations. State has submitted a report which reflects that the petitioner resides at Odisha and occasionally stays at his sister’s house. Petitioner has only very recently informed that he is unable to enter the house. 2 Be that as it may, petitioner would take out appropriate application before the jurisdictional court. The jurisdictional court would assess regarding the genuinity of the allegations and thereafter pass necessary directions, if there are no impediments for the petitioner to go and reside at his paternal house. With the aforesaid observations, the writ petition being WPA 15491 of 2025 is disposed of. There will be no order as to costs. All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities. (Tirthankar Ghosh, J.)
