This is first bail application filed under Section 483 of the Bhartiya Nagrik Suraksha Sanhita, 2023 for grant of regular bail to the applicant, as he was arrested in connection with Crime No. 54/2025 registered at Police Station – Civil Lines, District – Raipur (C.G.) for the offence punishable under Sections 420, 467, 468, 471 and 34 IPC. The case of the prosecution in brief is that the amount has been taken from the complainant and other person in order to provide the government job in food department, but after receiving the said amount, job has not been provided to the complainants, for which, complaint has been made and FIR under the aforesaid sections have been registered against the applicant and other accused persons. The role of the applicant as described by the prosecution is that the applicant has induced the complainants for the government job. 3. The learned counsel for the applicant submits that the applicant has been falsely implicated in the present case. He further submits that there were 9 accused persons involved in the offence in question and out of 9 accused persons, 7 accused persons have already been granted bail by this Court. He further submits that Swapnil Dubey has induced the victim for providing Government job and taken the amount directly and he has already been enlarged on bail in MCRC No.4444 of 2025. He further submits that the wife of the present applicant namely, Jhagita Joshi has already been granted bail by this Court in MCRC No. 3078 of 2025, co-accused Piyusha Joshi, who is daughter of present applicant has also been granted anticipatory bail in MCRCA No.310 of 2025 and other co- accused have already granted bail by this Court. The applicant is in jail since 29.01.2025 and the trial is likely to take some time for its conclusion.
Therefore, he prays for grant of bail to the applicant. 3

On the other hand, learned State Counsel appearing for the respondent/State opposes the bail application and submits that the applicant alongwith other co-accused persons are alleged to have committed fraud with the complainant and other persons, they allegedly took amount of Rs.25,00,000/- each from the complainant and other persons, to which the complainant paid in different installments in the name of providing government job for the post of Food Inspector, therefore, he is not entitled for grant of bail. 5. I have heard learned counsel for the parties and perused the case diary. 6. Taking into consideration the facts and circumstances of the case, nature and gravity of offence, period of detention of the applicant, particularly considering the fact that the applicant is a main accused in the present case and applicant alongwith other co-accused persons are alleged to have committed fraud with the complainant and other persons, they allegedly took Rs.25,00,000/- each from the complainant and other persons, which the complainant paid in different installments in the name of providing government job for the post of Food Inspector, Data Entry Operator and Patwari. The applicant’s wife and daughter were also involved in the crime as an co- accused, but they have been grated bail by this Court on the ground of their detention. The applicant being main accused in the present crime and also considering the fact that out of total
4 9 accused persons, 7 accused persons have already been granted anticipatory bail and regular bail by this Court, but the case of the present applicant is distinguishable from the case of the other co-accused persons, therefore, looking to the conduct of the present applicant, this Court does not find it a fit case to release the applicant on bail. 7.
Accordingly, this bail application of applicant – Devendra Joshi involved in Crime No. 54/2025 registered at Police Station – Civil Lines, District – Raipur (C.G.) for the offence punishable under Section 420, 467, 468, 471 and 34 IPC, is rejected at this stage. 8.
