1. By way of this petition, the petitioner has sought the following relief(s):-
“10.1 The Hon'ble Court may kindly be pleased to call for the entire records pertaining to the case before the learned Courts below for kind perusal. 10.2 The Hon'ble High Court may kindly be pleased to issue writ / writs, order / orders, direction / directions, thereby the learned First Additional Sessions Judge, Sakti District Janjgir-Champa (C.G.) be directed to decide the pending Criminal Case No. 71/2024
"Gajanand Rathore Versus Vimal Kumar" expeditiously, in the interest of justice. 10.3 Pass any other order under the facts and circumstances of the case, in the interest of justice.”
2. Learned counsel appearing for the petitioner would submit that a complaint case under Section 138 of the Negotiable Instruments Act, was filed before SIDDHANT TAMRAKAR Digitally signed by SIDDHANT TAMRAKAR Date: 2025.07.09 09:36:12 +0530
2 the learned trial Court and the learned trial Court passed judgment and convicted the respondent for period of 6 months with fine of Rs. 8,76,000/- vide judgment dated 05.11.2024. Respondent preferred an appeal before the learned First Additional Sessions Judge, Sakti, but same has not been decided yet. Thus, he would pray that a direction may be issued to the concerned Court to conclude the proceeding of Criminal Appeal No. 71/2024 within a stipulated time.
3. Taking into consideration the submission made by Mr. Yadav, this petition is
disposed of with a direction to the concerned Court i.e. First Additional Sessions Judge, Sakti, District Janjgir-Champa (C.G.) to make all endeavours to conclude the proceedings of pending Criminal Appeal No. 71/2024 expeditiously.
4. With the aforesaid observation(s), and direction(s), the instant petition is hereby disposed of. Sd/-
