...RESPONDENT(S): Petition under Article 226 of the Constitution of India praying that in the circumstances stated in the affidavit filed therewith, the High Court may be pleased topleased to issue any writ, order or Direction more particularly one in the nature of writ of Mandamus declaring the action of the Respondents trying to lay a 6 feet width road by completely burying the irrigation canal of 250 meters length situated in Survey Nos.228- B2, 229-B1, 230-2 and 231-2 of Kolluru Village, Kolluru Mandal, Bapatia District as the irrigation canal is being used by the Petitioners for their agricultural lands situated in Kolluru Village as illegal, arbitrary and in violation of Article 14, 19, 21 and 300-A of the Constitution of India and consequently direct the Official Respondent authorities to stop the laying of a 6 feet width road on the buried irrigation canal situated in Survey Nos.228-B2, 229-B1, 230-2 and 231-2 of Kolluru Village, Kolluru Mandal, Bapatla District and pass IA NO: 1 OF 2025 Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased pleased to pass an interim order by directing the Respondent authorities not to lay a road of 6 feet width on the buried irrigation canal situated in Survey NOS.228-B2, 229-B1 of Kolluru Village, Kolluru Mandal, Bapatia District, until disposal of the above writ petition, and pass IA NO: 2 OF 2025 Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased pleased to pass an interim order by directing the Respondent authorities to fully restore the irrigation canal of 250 meters length situated in Survey NOS.228-B2, 229-B1, 230-2 and 231-2 of Kolluru Village, Kolluru Mandal, Bapatia District which was buried for the purpose of laying of a road, until disposal of the above writ petition, and pass Counsel for the Petitioner(S):

ORDER:-
The present writ petition is filed by the petitioners making revenue and else as parties to the writ petition. On perusal of the prayer, it is evident that the relief is against the irrigation department and not pertaining to revenue department. 2. Sri M.Narendra Babu, learned counsel, representing learned counsel for petitioners, after arguing for sometime sought permission of this Court for withdrawal of writ petition with liberty to file fresh writ petition on the same cause of action. Learned counsel endorsed the same on the bundle. 3. Permission is accorded. 4. Accordingly, the Writ Petition is dismissed as withdrawn granting liberty to file fresh writ petition on same cause of action. There shall be no order as to costs.
